§ 1 Scope and contracting party

These Terms and Conditions apply to all orders that you place via our online shop at altairluggage.com.

Our offering is addressed both to consumers and to traders. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.

Deviating terms and conditions of the customer are not recognised unless we expressly agree to their application in writing.

§ 2 Conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

By clicking the order button, you submit a binding offer to purchase the goods contained in the shopping cart. Immediately after submitting your order, you will receive a confirmation of receipt of your order by email. This confirmation of receipt does not yet constitute acceptance of your offer.

The purchase contract is concluded when we expressly accept your order or when we ship the goods to you and inform you of this with a shipping confirmation.

The text of the contract is stored by us. The contract language is German.

§ 3 Prices

All prices stated are final prices in euros (EUR).

ALTAIR LLC is a company established in the United States and currently does not hold a German VAT identification number. Our invoices therefore do not show German value added tax.

The price stated in the shop at the time of your order is authoritative.

§ 4 Shipping costs

Shipping is free of charge for you. No additional delivery or shipping costs are incurred.

§ 5 Payment

The payment methods offered during the order process are available to you. The purchase price is due for payment upon conclusion of the contract.

Payment is processed via the payment service providers displayed at checkout. Your payment data is processed exclusively by these service providers; we do not receive any complete card details.

§ 6 Delivery

We deliver within Germany, to the countries of the European Union and to selected other countries.

The expected delivery time is 5 to 15 business days from conclusion of the contract. Information on delivery times constitutes non-binding estimates unless a binding delivery date has been expressly promised.

Should an ordered product unexpectedly not be available, we will inform you without undue delay and refund any payments already made without undue delay.

Partial deliveries are permissible insofar as they are reasonable for you; you will not incur any additional costs as a result.

§ 7 Retention of title

The delivered goods remain our property until payment has been made in full.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. You can find the details, the costs of return and the model withdrawal form in our Right of Withdrawal policy.

§ 9 Statutory warranty

The statutory rules on liability for defects apply. The limitation period for claims based on defects is two years from receipt of the goods in the case of new goods.

In the event of a defect, you are first entitled to supplementary performance, that is to say to repair or replacement delivery at your choice.

Please report defects by email to contact@altairluggage.com, ideally with photos and your order number. This speeds up processing considerably.

§ 10 ALTAIR guarantee

In addition to the statutory warranty, we grant a voluntary manufacturer's guarantee. You can find the conditions on the page ALTAIR Guarantee. This guarantee does not restrict your statutory rights.

§ 11 Liability

We are liable without limitation for damage arising from injury to life, body or health as well as for damage based on intent or gross negligence, and in accordance with the provisions of the Product Liability Act (Produkthaftungsgesetz).

In the event of slightly negligent breach of essential contractual obligations (obligations whose fulfilment is what makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract.

Liability is otherwise excluded.

§ 12 Vouchers and discount codes

Discount codes are valid only for the period and purpose specified in each case and cannot be paid out in cash.

Percentage discount codes cannot be combined with our volume discounts (bundles of several suitcases). If a percentage code is applied to an order that already contains a volume discount, the benefit that is more favourable for you is applied automatically.

Discount codes with a fixed amount (e.g. 20 €) can be combined with volume discounts.

One discount code can be redeemed per order.

§ 13 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have any problems, please contact us directly first.

§ 14 Applicable law

German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection granted to you by mandatory provisions of the law of the state in which you have your habitual residence.

§ 15 Final provisions

Should individual provisions of these Terms and Conditions be or become wholly or partly invalid, the validity of the remaining provisions shall remain unaffected.
